YOU MAY BE A CLASS MEMBER IN A PROPOSED CLASS ACTION SETTLEMENT
IF YOU MEET ALL OF THE FOLLOWING CONDITIONS:
1. You closed on a mortgage transaction for real property located in the State of
New Jersey on or after October 10, 2006;
2. You received settlement services from LSI Title Agency, Inc. ("LSI") in connection
with your mortgage transaction; and
3. You were charged a fee for recording the mortgage with a County Clerk in the
State of New Jersey that may have been in excess of the amount permitted to be charged
under New Jersey law.
A proposed settlement has been given preliminary approval in a class
action alleging that mortgage recording fees charged by LSI were improperly calculated
in violation of New Jersey common law and the New Jersey Consumer Fraud Act. LSI
denies that any law was violated.
Subject to the terms of the Settlement Agreement and the Court's approval, each
eligible class member who submits a timely and valid Claim form under penalty
of perjury may receive up to 100% of the overcharge in excess of the legally-permitted
mortgage recording fee. If you believe you are a class member, you may: (a) fill
out, sign and return a timely and valid Claim Form, (b) request exclusion from the
settlement, or (c) object to the settlement. You may only object to the settlement
if you do not exclude yourself and you are a class member.
